Aubrey practices in all areas of commercial real estate including purchase, sale, development, financing and leasing. He has extensive experience in the purchase and sale of real estate including both pre-development lands and lands with existing office, retail or industrial developments. He has completed land transactions with various unique aspects such as undivided interests among large groups of investors, appurtenant water licenses, environmental contamination, foreign ownership restrictions, options to purchase and developments in progress.
Aubrey acts for clients in relation to ownership structures and development of land including limited partnerships, cost share, co-ownership, management, contractor and lot sale agreements in addition to the review and preparation of utility rights of way, easements, restrictive covenants and municipal service provider and City forms. Aubrey regularly completes secured lending transactions on behalf of clients including in respect of acquisitions, construction projects and investment properties.
Aubrey’s experience prior to joining Rogers & Company includes practicing in the real estate group of a multinational law firm and acting as in-house real estate legal counsel at the Canadian office of a multinational group of companies engaged in the business of real estate investment and development. Having practiced in-house, he understands the expectations that in-house counsel have of external legal service providers and that legal services are part of the process to achieve business results.
